Mom died in August, landlord wants September rent.

A Winnipeg real estate company is coming under fire tonight.

The company is demanding an Aboriginal family pay September’s rent on their mother’s downtown apartment.

She died at the beginning of August.

    I think the province needs to change its current laws. Paying first and last month rent when you move in, ensures you can leave at any time and not worry about being harassed for the last month rent. Also, if the landlord wants you to leave, you get the last month to sort yourself out, or he has to repay you your last month rent back. In some respects problematic for low income people, but its sometimes helpful to get it back when you are heading to the next place.

  2. I would assume he can only get it from her estate and not from the family. Also, don’t you have first and last month rent? In which case he has already received the rent. Anyway, that is how the things work here in Ontario. Some landlords are so avaricious. Also, if he already rented out the apt, or was able to rent it out within the month – why should anyone pay the rent ‘owing’? Most places seem to have the place vacant for a couple weeks, while they prep for the next tenant. Hmm. guy is evil.

  3. There are laws that deal with this sort of situation. Firstly, the landlord CANNOT demand anything from anyone who is not named on the lease. Secondly, if they have a claim against someone who is deceased, they can petition the executor of the estate with a legal claim.
