The province of Ontario is appealing a ruling that ordered a new trial for a First Nation man charged with murder.

Last year, an Ontario court ruled that Clifford Kokopenace should get a new trial because he was not tried by a jury of his peers.

Lawyers with the province say that doesn’t matter.
